Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of ElevateUp (the “Service”), operated by Abhishek Bharti, an individual operating an independent product (not a registered company), based in Ghansoli, Navi Mumbai, Maharashtra, India. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & your account

You must be at least 18 years old to use the Service. You are responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.

2. What the Service does

ElevateUp is an AI communication and career coach. You record spoken answers to practice prompts; we transcribe them and use an AI model to produce a scorecard, a Universal Communication Index (UCI), and suggested drills. The feedback is generated automatically to help you practise and improve.

3. Not professional advice; no guaranteed outcomes

The scores, feedback, and drills are for self-improvement and informational purposes only. They are not professional, career, legal, medical, or psychological advice, and they are not a promise of any outcome — including any job, interview result, promotion, or income. You are responsible for how you use the feedback.

4. Subscriptions, billing & renewals

  • Paid plans are billed in Indian Rupees (INR) through our payment processor, Razorpay, at the prices shown at checkout (inclusive of applicable taxes unless stated otherwise).
  • Subscriptions auto-renew at the end of each billing term (for example, monthly, quarterly, half-yearly, or yearly) using your saved payment method, until you cancel.
  • You can cancel anytime from within the app or by emailing us. Cancellation stops future renewals; you keep access until the end of the period you have already paid for.
  • Each paid plan includes a set number of AI analyses per billing cycle (the exact allowance for your plan is shown in the app). Your allowance resets each billing cycle on your renewal date and does not carry over to the next cycle. Plans described as “unlimited” are subject to reasonable fair-use limits shown in the app.
  • Refunds are handled under our Refund & Cancellation Policy.
  • Prices and plans may change; we will give reasonable notice, and changes apply to future terms.

5. Your content

You keep ownership of the recordings and information you provide (“Your Content”). You grant us a limited licence to process Your Content solely to operate and provide the Service to you (including sending it to the transcription and AI providers described in our Privacy Policy). You confirm that you have the right to record and upload Your Content, and that recording it does not violate anyone else’s rights.

6. Acceptable use

You agree not to:

  • Upload audio of other people without their consent, or any unlawful, infringing, or harmful content.
  • Misuse, disrupt, overload, reverse-engineer, or attempt to gain unauthorised access to the Service.
  • Resell or commercially exploit the Service without our permission, or use it to build a competing product.
  • Circumvent usage limits, entitlements, or security controls.

7. Our intellectual property

The Service — including the software, the UCI scoring methodology, designs, and branding — is owned by us and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service under these Terms. No other rights are granted.

8. Service availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and perform maintenance, from time to time.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.

11. Indemnity

You agree to indemnify and hold Abhishek Bharti harmless from claims arising out of Your Content or your breach of these Terms or of applicable law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. Provisions that by their nature should survive termination (for example, IP, disclaimers, limitation of liability) will survive.

13. Referral program

We may offer a referral program that lets you share a referral code or link. The current rewards, eligibility and any limits are shown in the app and may change or be withdrawn at any time. By taking part you agree that:

  • Rewards are earned only when a validly referred new user completes a genuine paid subscription — not on sign-ups alone.
  • A reward may take the form of bonus subscription access (extra days of a paid plan) or, for approved creators, a cash commission — whichever is shown at the time. Bonus subscription access has no cash value and is non-transferable.
  • The program is single-level: you earn only for users you directly refer. There is no multi-level, chain, or recruitment-based earning.
  • Cash rewards are held for a period after the referred subscription before they become payable, so refunds and chargebacks can be accounted for. A reward tied to a payment that is refunded or reversed is void.
  • Self-referral, fake or duplicate accounts, and any attempt to manipulate the program will void rewards and may lead to suspension. We may withhold or reverse rewards linked to refunds, chargebacks, or abuse.
  • You are responsible for any taxes on cash payouts you receive. We may modify, pause, or end the program at any time.

14. Governing law & jurisdiction

These Terms are governed by the laws of India, and specifically Maharashtra, India. The courts at Navi Mumbai will have exclusive jurisdiction, subject to any applicable consumer-protection rights you have under Indian law.

15. Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
